Clarification About Recent State Enforcement Actions

There has been some confusion regarding recent letters sent by state enforcement authorities, including the Minnesota and Vermont attorneys general, instructing retailers not to sell unauthorized e-cigarette and oral nicotine products and warning them of the consequences for such sales. We encourage efforts to support a well-regulated marketplace for vapor products and believe these actions are an important step in the right direction, but these communications have no impact on JUUL products.

All JUUL products currently sold in each state may continue to be sold in those markets. Below you will find statements clarifying this point from select enforcement authorities. Please reach out to your Juul Labs representative if you have questions about another state or jurisdiction.

Several states legislatures have enacted product directories (see embedded links below for specific guidance), while others have passed product directories this year but are yet to be implemented. The directories allow states to prohibit the sale of vapor products that are not authorized by the U.S. Food & Drug Administration (FDA) or subject to a pending premarket application. These laws are intended to reduce the proliferation of illicit vapor products. This chart will be updated as states implement product directories.

JUUL Labs, Inc. enters into additional State Settlements | Last updated May 31, 2023

Resolution of issues from the company’s past and its historical legal challenges has remained a critical priority to secure certainty for our future. We are pleased to have reached a settlement with eight additional states (California, Colorado, Illinois, Massachusetts, Minnesota, New Mexico, New York, and West Virginia) and the District of Columbia. We have now settled with 48 states and territories, providing over $1 billion to participating states to further combat underage use and develop cessation programs. The terms of the agreement, like prior settlements, reflect our current business practices, which were implemented as part of our company-wide reset in the fall of 2019. As part of the agreement, Juul Labs has committed to providing financial resources to further combat underage use and develop cessation programs.

JUUL Labs, Inc. and the Multistate Settlement | Last updated April 10, 2023

Our settlements with state Attorneys General are a significant part of our ongoing commitment to resolve issues from the past. The terms of the agreements are aligned with our current business practices, which we started to implement after our company-wide reset in the fall of 2019. We had previously settled with the Attorneys General of North Carolina, Louisiana, Arizona and Washington. In the fall of 2022, we reached settlements with over 30 states and Puerto Rico. As part of these settlements, we have updated the “Penalty Enforcement Policy” for Mystery Shop failures located on the Juul Labs Authorized Reseller Policy. The effective dates of these settlements are indicated in the table below.

JUUL Labs, Inc. FDA Market Order Updates | July 22, 2022

While we wait for the regulatory review process to be completed, we’ve addressed common questions that you may have.

JUUL Labs, Inc. granted Administrative Stay | July 5, 2022

On July 5, 2022, the FDA agreed to an administrative stay of our marketing denial order (MDO), until a regulatory review process is completed. As we move through this review process, retailers are authorized to continue selling JUUL products.

Washington State Settlement Agreements | April 12, 2021

Starting April 12, 2022, Juul Labs will require all Washington retailers of JUUL products to implement Enhanced Access Controls.

Louisiana Settlement Agreement | March 2, 2021

On March 2, 2022, Juul Labs, Inc. entered into a Settlement Agreement with the State of Louisiana. No action from retailers is required at this time.

Arizona Settlement Agreement | November 23, 2021

Starting July 30, 2022, Juul Labs will require all Arizona retailers of JUUL products to implement Enhanced Access Controls.

North Carolina Settlement Agreement | August 4, 2021

Starting February 14, 2022, Juul Labs will require all North Carolina retailers of JUUL products to implement Enhanced Access Controls.
